Mac Miller‘s arrest for driving under the influence and the subsequent charges he faced will be dropped by prosecutors because of his death.

TMZ reported that the Los Angeles City Attorney’s Office will officially drop the charges against the late rapper. He was supposed to be arraigned on Tuesday.

Miller was arrested in May after he struck a curb and collided with an electrical pole. The “Fight the Feeling” rapper and two passengers then fled on foot. He was arrested for DUI at his home an hour later.

Two months later, Miller called the arrest an eye-opening experience that he thought would help him clean up his act.

“I made a stupid mistake,” he told Apple Music’s Beats 1 in July. “I’m a human being. But it was the best thing that could have happened.”

In August, Miller was charged with two counts of DUI: one for driving under the influence and one for driving with a blood-alcohol level of .08 or above.

Miller, whose real name was Malcolm James McCormick, died Friday of an apparent overdose at the age of 26. An autopsy has been completed but the cause of death won’t be announced until the results of toxicology tests return, which can take weeks or months.
